1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ADHD Harmony B.V. ("ADHD Harmony", "we", "our", or "us") governing your access to and use of Harmony AI, accessible at app.adhdharmony.com (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Harmony AI is an AI-powered productivity and wellness application designed specifically for individuals with ADHD. The Service provides:

  • AI chat assistance for task management and productivity support
  • Daily check-in functionality to track mood, energy, and focus
  • Guided worksheets based on evidence-based practices
  • Personal knowledge base for storing insights and resources
  • Integration with Google Tasks and Google Calendar (optional)

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Third-Party Integrations

The Service offers optional integration with third-party services, including Google Tasks and Google Calendar. By connecting these services:

  • You authorize us to access and use data from these services as described in our Privacy Policy
  • You acknowledge that your use of third-party services is governed by their respective terms and privacy policies

You retain ownership of any content you submit, post, or display through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of providing and improving the Service.

7. Health Disclaimer

Important: Harmony AI is a productivity and wellness tool, not a medical device or healthcare service. The Service:

  • Does NOT provide medical advice, diagnosis, or treatment
  • Is NOT a substitute for professional medical care, mental health treatment, or therapy
  • Should NOT be used in emergency situations

Always seek the advice of your physician, psychiatrist, or other qualified health provider with any questions you may have regarding ADHD or any other medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or experienced through the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADHD HARMONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers or your personal information
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service

10. Indemnification

You agree to defend, indemnify, and hold harmless ADHD Harmony and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
